INFINITY COVES UK
TERMS AND CONDITIONS OF INSTALLATION
The following conditions are applied to The Client from Infinity Coves UK of 14 Bodmin Street, London, SW18 4PT.
Interpretation; in this contract “The Client” means the person, firm, company, representative of a firm or company, or other individual or organisation enlisting the services of Infinity Coves UK.
The Client agrees to the following:
TERMS AND CONDITIONS OF INSTALLATION
The following conditions are applied to The Client from Infinity Coves UK of 14 Bodmin Street, London, SW18 4PT.
Interpretation; in this contract “The Client” means the person, firm, company, representative of a firm or company, or other individual or organisation enlisting the services of Infinity Coves UK.
The Client agrees to the following:
- The Client will pay Infinity Coves UK the final invoice for the installation within a maximum of thirty (30) days of invoice, unless otherwise stated by Infinity Coves UK on the invoice. By the client placing an order via phone or email this constitutes a business transaction, thus creating an agreement into which both parties are freely entering.
- A cancellation charge of fifty percent (50%) of the full invoice value shall be payable to Infinity Coves UK if notice of cancellation is given more than seven (7) days prior to the scheduled commencement date. A cancellation charge of one hundred percent (100%) of the full invoice value shall be payable to Infinity Coves UK if notice of cancellation is given less than seven (7) days prior to the scheduled commencement date.
- In case of unpaid invoices Infinity Coves UK holds the right to charge a three percent (3%) interest rate per calendar month over any outstanding invoices until full payment has been made. If a debt collector, solicitors or a debt collection agency needs to be appointed, The Client will be liable for all charges incurred by Infinity Coves UK.
- Provisional bookings are taken on the understanding that they do not guarantee a scheduled commencement date for the installation until the agreed deposit has been paid.
- The Client agrees to engage Infinity Coves UK to provide The Client with building an infinity cove at the address specified based on a price quoted and agreed on previously.
- The clauses of this contract will start on the date the agreement has been signed by all parties and will remain in full application and effective until the finishing date of the works agreed. This includes any unforeseen circumstances resulting in a later finishing date than specified, and in which case the contract will remain in place until the agreed work is completed. If both parties agree, the finishing date can be extended or amended for any reason.
- Both parties in the agreement agree to do each and everything in their power to keep the contract in application and not to violate any of the terms and conditions added in the contract. This also includes not performing any task that could result in early termination of the contract.
- The Client must agree the specification of the work and materials and such acceptance must be done ahead of the work. Infinity Coves UK has provided a quote based on such specification for the quality, or grade of the goods based on the budget provided. Should there be a discrepancy, The Client must specify the basis of the claim in detail and prior to the start of the work. Failure of The Client to comply with these conditions will constitute irrevocable acceptance of the goods by The Client. All notices between the parties must be in writing and delivered by courier or by certified mail, return receipt requested.
- The agreed work will be carried out at the highest standard as per the quote supplied and will be finished and ready to use upon completion. Infinity Coves UK would only carry out maintenance work under the standard three (3) month warranty if there is major structural damage in which the construction as a whole presents a health and safety hazard, and not due to wear and tear or negligence caused by The Client, any employees of the Client, any visitors to The Clients premises or any contractors hired by The Client. Upon completion of the job, and when the installation has been signed off by The Client, wear and tear maintenance will be the sole responsibility of The Client unless agreed otherwise with Infinity Coves UK.
- If any legal action is taken due to any reasons or violation of the contract by any party, the concerned partner reserves the right to recover all the legal fees and costs from the other party.
- All notices, demands, requests, applications and any other communication in between both the parties will be conducted on paper and/or email so that it can serve as evidence in future. The notices are required to send to the other party in time and on the given address at the beginning of the contract.
- Infinity Coves UK may, without liability, delay performance or cancel the contract on account of force majeure events or other circumstances beyond its control, including, but not limited to, strikes, acts of God, political unrest, embargo, failure of source of supply, or casualty.
- The Client is responsible for the arrangement and cost of any aftercare cleaning of the Premises unless otherwise agreed in writing.
